These Terms of Service ("Terms") are a binding agreement between you ("you," "Customer") and James Taylor is IT, LP, doing business as JuJu Hosting ("JuJu Hosting," "we," "us"). By creating an account, purchasing, or using our hosting, control-panel, email, domain, or related services (the "Services"), you agree to these Terms, our Privacy Policy, and our Refund Policy. If you do not agree, do not use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind it.
1. Eligibility & accounts
You must be at least 18 and legally able to enter contracts. You are responsible for your account credentials and for all activity under your account, and must provide and maintain accurate registration and billing information. Notify us immediately of any unauthorized use at abuse@jujuhosting.com.
2. The Services
We provide managed web hosting and related services on a subscription basis. Plan features, resources, and pricing are described at purchase and may be adjusted with notice. We may modify, add, or discontinue features; where a change is materially adverse to a paid feature you rely on, we will provide reasonable notice.
3. Fees, billing & auto-renewal
- Subscriptions are billed in advance on a recurring monthly or annual basis and automatically renew at the then-current rate until cancelled.
- You authorize us and our payment processors (Stripe, PayPal) to charge your payment method for each renewal. You can cancel anytime from your panel or by contacting us; cancellation stops future renewals and access continues through the end of the paid term.
- Domain registrations, transfers, renewals, and third-party add-ons are billed separately and are generally non-refundable once ordered (see Refund Policy).
- Taxes are your responsibility where applicable. Failed or reversed payments may result in suspension.
- EU/EEA/UK consumers: where you have a statutory right of withdrawal for digital services, you acknowledge that by requesting immediate provisioning you consent to performance beginning before the withdrawal period ends; our voluntary money-back guarantee in the Refund Policy applies regardless.
4. Acceptable Use Policy
You may not use the Services to store, transmit, or link to, nor permit any end user to:
- violate any law or third-party right, including intellectual-property, privacy, and export-control laws;
- distribute malware, run phishing, carding, or fraud operations, or attempt unauthorized access to any system;
- send unsolicited bulk email (spam) or violate anti-spam laws (e.g., CAN-SPAM, GDPR/ePrivacy);
- host child sexual abuse material (CSAM), content that is unlawfully obscene, promotes terrorism, or incites violence — CSAM is reported to authorities and NCMEC;
- infringe copyrights or trademarks (see §5), or resell the Services except as expressly authorized;
- consume resources in a way that degrades the platform for others, run open proxies/relays, mine cryptocurrency, or launch or facilitate DoS/DDoS activity.
We may investigate suspected violations and, at our discretion, remove content, throttle, suspend, or terminate accounts. Where practical we give notice, but we may act immediately for severe abuse, security threats, or legal risk. Report abuse to abuse@jujuhosting.com.
5. Copyright / DMCA
We respond to valid notices under the U.S. Digital Millennium Copyright Act. Send takedown notices and counter-notices to legal@jujuhosting.com with all information required by 17 U.S.C. §512. Repeat infringers will be terminated.
6. Your content & responsibilities
You retain ownership of the content and data you upload ("Customer Content"). You grant us the limited license to host, copy, transmit, back up, and display Customer Content solely to operate the Services. You are solely responsible for Customer Content, for having the rights to it, for your own end users, and for maintaining your own backups. We provide backups as a convenience, not a guarantee.
7. Availability & support
We target high availability and monitor the platform continuously, but the Services are provided without a contractual uptime guarantee unless a separate written SLA applies. Scheduled maintenance, third-party failures, force majeure, and events beyond our reasonable control may cause interruptions.
8. Suspension & termination
We may suspend or terminate the Services for non-payment, violation of these Terms or the AUP, legal requirement, or risk to the platform or others. You may terminate at any time. On termination, your right to use the Services ends and Customer Content may be deleted after a reasonable retention window; export your data before cancelling.
9. Disclaimers
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, JUJU HOSTING WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR LOST PROFITS, REVENUE, GOODWILL, OR DATA. OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE THREE (3) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. Nothing limits liability that cannot be limited by law (including, for consumers, statutory rights).
11. Indemnification
You will defend, indemnify, and hold harmless JuJu Hosting and its affiliates from claims, damages, and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Services, or your violation of these Terms or any law.
12. Governing law & disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws rules. The exclusive venue for disputes is the state and federal courts located in Potter County, Texas, and you consent to that jurisdiction. Consumers may have mandatory rights under the laws of their home country that this section does not override.
13. Changes
We may update these Terms; the "Effective" date reflects the latest version and material changes will be communicated by email or in the panel. Continued use after changes take effect constitutes acceptance.
